"Under the First Amendment, there is little the government can do to limit false information. The only time the government gets involved with false statements is when they are made to officials investigating a crime, made to defraud people for money, or designed to harm a persons reputation. A growing number of scholars are questioning whether the traditional model of countering bad speech with better speech can meet challenges of a digital society replete with software designed to overwhelm social media with harmful expression. Since human judgement is imperfect, the targeting of harmful speech will likewise be imperfect, leading, inevitably, to the suppression of some speech that may be true and useful"--.
